Rights reserved for the benefit of other land There is excepted and reserved for the benefit of the Retained Land a right of way for the Transferor and all persons authorised by him at all times and for all purposes with or without vehicles over the accessway shown coloured blue on the Plan Restrictive covenants by the transferee For the benefit and protection of the Retained Land and any part of it and so as to bind the Property and any part of the Property into whosever hands the same may come, the Transferee and its successors in title covenant with the Transferor and its successors in title that the Transferee and its successors in title shall not use the Property for any use other than open space which may include recreation and ecological/biodiversity purposes. Positive covenants by the transferee The Transferee covenants with the Transferor for the benefit of the Retained Land and each and every part of it with the intention of binding the Property and each and every part of it to maintain a good and sufficient stock proof fence along the eastern boundary of the Property and to maintain it in good repair and stock proof condition.
